Official Rules

  1. General. NO PURCHASE NECESSARY TO ENTER OR TO WIN. By participating in or submitting an entry to this Sweepstakes, sponsored by Delaware North Companies, Inc.- Boston, 100 Legends Way, Boston, MA 02114 ("the Sponsor"), the entrant acknowledges and agrees to these Official Rules. Sweepstakes begins on July 16, 2009 at 12:00 pm EST and ends on July 16, 2009 at 8:00 pm EST. Grand prize drawing to be conducted on July 17, 2009. By participating or entering, entrants agree to be bound by these Official Rules and by all decisions of the Sponsor, whose decisions are binding and final. Failure to comply with these rules will result in disqualification from this Sweepstakes. This Sweepstakes is void where prohibited.
  2. Eligibility. This Sweepstakes is open only to U.S. citizens or legal residents who reside in the states of Massachusetts, New Hampshire, Maine or Connecticut, who are 13 years of age or older as of July 16, 2009. If winner selected is under 18 years of age, the prize will be awarded to the winner's parent or legal guardian. Parent or legal guardian must be 18 years of age or older as of July 16, 2009, and must conform to the eligibility requirements set forth in these Official Rules. This Sweepstakes is void wherever prohibited or restricted by applicable federal or state laws and regulations. Employees of the Sponsor, TD Bank Financial Group (including, without limitation, TD Bank, N.A.), Boston Professional Hockey Association, Inc. d/b/a the Boston Bruins, the Boston Celtics, the Boston Blazers, and their respective parent companies, subsidiaries, affiliates, officers, directors, agents, employees, advertising and promotion agencies and family members living in their immediate household (spouses, parents, children, and siblings and their spouses) are not eligible to participate or win any prize.
  3. How To Enter. Free TD Garden Golden Ticket Giveaway chocolate bars will be handed out at certain specified locations during the contest period. Entry to the contest is comprised of receiving and opening the outside wrapper of a free TD Garden chocolate bar on Thursday, July 16, 2009 at any of the following locations: TD Garden, 100 Legends Way, Boston, MA, or any of the following TD Banknorth branch locations: 880 Massachusetts Ave, Arlington, MA; 449 Boston Road, Billerica, MA; 579 Boylston Street, Boston, MA.; 15 Broad Street, Boston, MA; 75 Federal Street, Boston, MA; 44 Granite Street, Braintree, MA; 298 Washington Street, Brighton, MA; 1641 Beacon Street, Brookline, MA; 457 Broadway, Chelsea, MA; 420 Franklin Street, Framingham, MA; 74 Concord Street, Framingham, MA; 770 Water Street, Framingham, MA; Route 9/25 Prospect Street, Framingham, MA; 1265 Worcester Road, Framingham, MA; 1840 Massachusetts Ave., Lexington, MA; 154 Worcester Street, Natick, MA; 1013 Great Plain Ave, Needham, MA; 95 Highland Ave, Needham, MA; 1197 Centre Street, Newton Centre, MA; 411 Broadway, Revere, MA; 305 Second Ave, Waltham, MA; 380 Washington Street, Wellesley Hills, MA; Route 9/999 Worcester Street, Wellesley, MA; 280 Montvale Ave., Woburn, MA (each, a "Location"). Wrappers must be opened on site at the Location to be eligible. Any wrapper opened outside of a Location will be void. Limit one chocolate bar per person at each Location, except that (i) certain radio and/or newspaper contest winners and (ii) certain individuals who receive passwords via free Internet sites Facebook.com and Twitter.com from Sponsor may win the right to receive multiple bars in accordance with the terms of such contests or offers. Chocolate bars will be handed out at the Locations starting at 12:00 PM EST on July 16, 2009 and continuing until 4:30 PM EST July 16, 2009, while supplies last. Chocolate bars may not be evenly distributed across the Locations. At Sponsor's discretion, any remaining chocolate bars (if any) may be handed out at the TD Garden or certain areas adjacent to the TD Garden between the hours of 4:30 and 7:00 PM EST on July 16, 2009 as determined by Sponsor. There is no guarantee that chocolate bars will be or remain available at all Locations. The contest period will end no later than 8:00 PM EST on July 16, 2009. Any chocolate bars left over after the contest period will not be distributed, and any associated prizes will be null and void.
  4. Selection of Winner. The Sweepstakes consist of two rounds of drawings. During the first round, up to 917 entrants (a possible total of 5 Golden Ticket winners and 912 winners of alternate prizes) may win prizes on July 16, 2009 by opening winning wrappers. Wrappers must be opened on site at the Location to be eligible. Any wrapper opened outside of a Location will be void. Winners must identify themselves and show their winning wrapper to Sponsor staff at the Location. A total of 19,600 chocolate bars will be made available at the Locations. The wrapper will reveal the prize to be awarded to the entrant. Entrants who receive a Golden Ticket will proceed to the second round. During the second round, one grand prize winner will be selected from the Golden Ticket winners via random drawing to be held at the TD Garden on Friday, July 17, 2009 at approximately 10:45 am EST. Golden Ticket winners, or an eligible representative, are encouraged to be present for the drawing to win the grand prize. If the grand prize winner is not present at the July 17, 2009 drawing, he/she will be notified by the Sponsor. Golden Ticket holders who do not win the grand prize will receive a Golden Ticket consolation prize. The odds of winning a Golden Ticket or alternate prize depend on the number of chocolate bars opened by entrants. Winners will be notified and confirmed immediately on location in person by on site promotional staff. Winners will be required to sign and return to the Sponsor an affidavit of eligibility and liability release before any prize is awarded. In the event of non-compliance with any of these requirements, the prize will be forfeited. Sponsor reserves the right to award the prize to an alternate winner in the event of forfeiture or disqualification, or if winner's contact information as provided to Sponsor is incorrect.
  5. Prize Pool. Prizes will be awarded from the following potential prize pool: One (1) grand prize which includes a pair of Season Tickets to the TD Garden for the 2009-2010 regular season including: season tickets to the Boston Bruins, Boston Celtics, and Boston Blazers, eight (8) concerts, and a performance of Disney On Ice, Ringling Brothers and Barnum Bailey Circus, Harlem Globetrotters, World Wrestling and Entertainment, Beanpot Tournament, and Hockey East Tournament; and a $500 Garden Gold card. Approximate Retail Value ("ARV") of grand prize is estimated at $22,606.00. Up to Five (5) Golden Ticket prize packages which include: a behind the scenes tour of the TD Garden for the winner and a guest, a gift bag, 2 autographed memorabilia items, limousine service to and from the TD Garden for the arena tour; and a gift bag for their guest. ARV of a Golden Ticket Prize Package is $623.00. Each Golden Ticket winner who does not receive the grand prize will be awarded Golden Ticket consolation prizes which include: 2 tickets to a 10-game combination Bruins and Celtics package and a $500 Garden Gold Card. ARV of a Golden Ticket consolation prize is $2,660.00. Up to nine hundred and twelve (912) alternate prizes may be awarded including: 200 25% off vouchers in the Boston Bruins Pro Shop, ARV = $0.00, 500 10% off vouchers in the Boston Bruins Pro Shop, ARV = $0.00, 20 pairs of tickets to a Boston Bruins game, ARV = $200.00 per pair, 20 pairs of tickets to a Boston Celtics game, ARV = $250.00 per pair, 5 pairs of tickets to a concert, ARV = $220 per pair, 50 pairs of tickets to a performance of Ringling Bros. Barnum & Bailey Circus, ARV = $50.00 per pair, 50 pairs of tickets to a performance of Disney on Ice, ARV = $50.00 per pair, 5 pairs of tickets to the Beanpot Tournament, ARV = $360.00 per pair, 1 suite to a Boston Celtics game, ARV = $3,375.00, 1 suite to a Boston Bruins game, ARV = $3,698.00, 20 $25 TD Banknorth Visa Debit Cards, ARV =$25 each, and 40 $25 Garden Gold Cards, ARV = $25 each. Total prize pool value = $61,834.00. Prizes not claimed by a winning ticket will not be awarded, and will be deemed forfeited at the completion of the Sweepstakes. All tickets are regular season tickets only and do not include pre or post season events. Specific event dates for all ticket package winners are at the sole discretion of the Sponsor and subject to limitations and special conditions. Grand prize ticket package includes only the events listed above and will not include any additional events or private events added to the TD Garden calendar for the 2009-2010 season. All merchandise gifts are non-refundable and cannot be exchanged for alternate sizes. The Sponsor reserves the right to substitute a similar prize of equal or greater value at its sole discretion. If winner selected is under 18 years of age, the prize will be awarded to the winner's parent or legal guardian. Parent or legal guardian must be 18 years of age or older as of July 16, 2009. Prizes cannot be exchanged for cash and there are no date substitutions. Transfer or resale of the prize or any portion of a prize is prohibited. The use of any tickets associated with a prize is subject to additional policies and terms and conditions. All confirmed eligible winners may redeem their prize as indicted in the contest forms presented to the winner on location by the Sponsor.
  6. Release, Waiver And Consent. By entering, entrants agree to and do hereby waive and release Sponsor, TD Bank Financial Group, including without limitation, TD Bank, N.A., Boston Professional Hockey Association, Inc. d/b/a the Boston Bruins, the Boston Celtics, the Boston Blazers and their respective divisions, affiliates, parent companies, subsidiaries, advertising and promotion agencies and any one associated with the production of this Sweepstakes, and their respective directors, officers, employees and agents, from any and all liability for any claims, injuries, losses or damages (including attorneys fees) of any kind arising out of their participation in this Sweepstakes or resulting from acceptance, possession, receipt, use or misuse of any prize, and entrants agree that these entities are in no manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, relating to the Sweepstakes and/or the awarding or use of any prize. By acceptance of a prize, each winner hereby consents to the use of his or her name, address, voice, photographs and/or likeness, biographical and prize information and/or statements about the Sweepstakes for advertising or publicity purposes for this and similar promotions without compensation (except as otherwise prohibited by law). Winners will be required to confirm the release, waiver and consent contained in this paragraph by signing and returning to the Sponsor an affidavit of eligibility and liability release before any prize is awarded.
  7. Error or Interference. If for any reason, the Sweepstakes is not capable of running as planned for any reason, including printing errors, infection by computer virus, bugs, tampering, and unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sponsor which corrupt or affect the administration, security, fairness, integrity of the game or Sweepstakes, the Sponsor reserves the right in their discretion to disqualify any individual it believes has tampered with the entry process, and/or to cancel, terminate, modify or suspend the Sweepstakes. The Sponsor, TD Bank, N.A., and their respective parent companies, subsidiaries, affiliates, officers, directors, agents and employees (i) assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and (ii) are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or internet service providers, computer equipment, software, failure of any email to be received by the Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to the participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes. If there is a dispute as to the identity of an online entrant, the prize will be awarded to the authorized account holder of the email address. The "authorized account holder" is defined as the natural person to whom the email address is assigned by an internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
  8. Disputes/Choice Of Law: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, exclusively by state or federal courts situated in Boston, Massachusetts, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall attorneys' fees be recoverable by entrant; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. Massachusetts law, without reference to Massachusetts' choice of law rules, governs the Sweepstakes and all claims related thereto.

  11. Responsibility for Taxes and other Costs and Expenses. In order to claim a prize with an ARV of $600 or greater, each winner will be required to provide Sponsor with properly executed IRS forms reflecting the winner's social security number or other taxpayer identification number. Winner shall be solely responsible for paying all taxes associated with the prize, and winner shall be solely responsible for all other expenses costs or fees, including parking and transportation, associated with the acceptance and/or use of the prize.
